Summary: | Spontaneous abortion amongst women is a current phenomenon that has become a domestic as well as global issue. This article attempts to comprehend its definition and concept in terms of its technical aspect with reference to its medical understanding through Islamic perspective. It does not only focus on the concept of abortion, but also to verify theapproach used in the act of abortion. Besides, the discussion intends to clarify in details the causes of abortion amongst the women in Malaysia, in particular and globally, in general. This study has found that illegal non marital sex which is a syariah crime has recorded the highest number of incidence as compared to other crimes. This research also focuses on the effect of abortion from the aspects of mother's health as well as social and medical implication. Besides that, the paper will see the extent in terms of provisions and penalties in relation to abortion under Malaysia Criminal Acts and the Islamic perspective. In conclusion, this paper presents a critical analysis through comparative methodology in order to present suggestions, proposals as well as the mechanism to enhance the available system to help alleviate the issue on how to resolve spontaneous abortion.
